Successful Representation of Client in Estate Proceeding

Jones Foster litigation shareholders Peter A. Sachs and Scott G. Hawkins and attorney Alexander L. Brams served as counsel for the personal representative in a will and trust contest in Palm Beach County Circuit Court.

The personal representative’s siblings and beneficiaries of the decedent’s estate brought claims against the personal representative, alleging, inter alia, undue influence, conversion, and fraud and seeking an accounting, damages, revocation of the decedent’s will, and removal of the personal representative.

The case proceeded to a nine-day bench trial and the Court ruled in the personal representative’s favor on all counts, dismissing the fraud and conversion counts mid-trial, finding that the personal representative had not unduly influenced the decedent, and upholding the decedent’s estate plan.
