International Collaboration Results in $250+ Million Credit Facility

Jones Foster Corporate attorney, Kevin T. Lamb, and Real Estate attorney, Peter S. Holton, served as lead U.S. counsel for a multinational firm seeking a $250+ million asset-based credit facility to fund capital investments in strategic real estate projects around the globe.

Experienced in the handling of sophisticated commercial transactions in their respective practice areas, Kevin Lamb and Peter Holton represented the client’s Florida-based entities in connection with the transaction and assisted with the negotiation of the security agreement, facilities agreement, and other related loan documents and instruments, opining on the legality, validity and enforceability of the documents.

The unique nature of this transaction lies in its scope. The client’s international holdings and the significant amount of revolving credit sought required assemblage of collateral in various forms from numerous single-purpose LLCs and corporations within numerous jurisdictions. Layers of contingencies created an additional level of complexity, necessitating collaboration with multidisciplinary teams from several of the most prestigious law firms in Europe and North America.

A $250+ million Europe-based credit facility was successfully secured, enabling the client to access funding for ongoing operations, the completion of construction projects, and future acquisitions.
